Policy

A Pre-Release Medi-Cal (MC) evaluation is to be conducted prior to a County and State inmate’s release from incarceration, to ensure inmates have access to health coverage.  If the inmate is eligible, a temporary Benefits Issuance Card (BIC) is provided upon the inmate’s release.


Background

In January 2008, the Department of Health Care Services (DHCS) entered into an agreement with the California Department of Corrections and Rehabilitation (CDCR) to facilitate the completion, and submittal of MC applications for State inmates and wards of CDCR prior to their release.  The purpose of the agreement is to ensure that pre-release MC applications are processed before the release date, so that individuals released from incarceration are eligible to MC upon release. 

Senate Bill (SB) 1469 and California WIC Section 14029.5 (a)(1) targeted minor inmates who were not receiving MC at the time of incarceration.  It required that juvenile detention facilities provide the County Welfare Department (CWD) with the upcoming release date of minors in their custody, in order for the Department of Public Social Services (DPSS) to assess and establish MC eligibility upon the minor’s release.  This is known as the Juvenile Justice Project (JJP) in Los Angeles County. 

In January 2014, Assembly Bill 720 went into effect authorizing counties to designate an entity or individual in the county, to act on behalf of county inmates, and help county inmates apply for MC.  

Whole Person Care (WPC) – LA Reentry Program (County Inmates) 

On May 8, 2017, the Department of Health Services (DHS) implemented a soft launch for the WPC – LA Reentry Program pilot with DPSS and the Los Angeles Sheriff’s Department (LASD).

DHS solicited the assistance of LASD and DPSS to support their efforts in enrolling County inmates into MC by ensuring inmates, meeting the WPC criteria, are able to access healthcare upon their release.

The WPC – LA Reentry Program is a Medi-Cal 2020 waiver-funded program that provides comprehensive and coordinated services to the sickest and most vulnerable County residents. Fifteen programs bring together health and social service delivery entities across the County to deliver seamless, coordinated services to individuals experiencing:

  1. Homelessness;
  2. Justice Involvement;
  3. Serious Mental Illness;
  4. Severe and/or persistent substance use disorder; or
  5. High-risk/complex medical issues.

Definitions

Terms and Descriptions


Inmate

For the purpose of this document, “inmate” describes an individual who is incarcerated in a public institution for a criminal offense, regardless of age.


Minor

For purposes of this document, “minor” is defined as a person under the age of 21.


Public Institution

An institution that is under the responsibility of a governmental unit, or over which a governmental unit exercises administrative control.  The following are public institutions:

  1. State or Federal prisons;
  2. Correctional facilities;
  3. County, City or tribal jails;
  4. Detention centers;
  5. California Youth Authority (CYA) camps; and
  6. CDCRs Custody to Community Transitional Reentry Program (CCTRP)/Enhanced Alternative Custody Program (EACP), Female Offender Treatment and Employment Program (FOTEP), or Male Community Reentry Program (MCRP) facilities.

Single Streamlined Application (SSApp)

SSApp is used to apply for a range of affordable health care coverage options, including free or low cost MC. This form collects tax household information, income, and individual demographics, among other things.


Juvenile Justice Project (JJP)

The Los Angeles County project name for the SB 1469 pre-release application process for minor inmates.


Department of Health Care Services (DHCS) 

The California State agency responsible for the MC Program.


California Department of Corrections and Rehabilitation (CDCR)

Responsible for the operation of the California State prison and parole systems.  CDCR is authorized to maintain the custody and care of California’s institutionalized public offenders.


Inmate CDCR Number

The number provided on the CDCR Cover Letter to identify an inmate for which a Pre-Release application is submitted.


CDCR Transitional Case Management Program (TCMP) Benefit Worker

CDCR staff responsible for identifying inmates who will be released within 90 days from a State prison and will assist the inmate in completing a Single Streamline Application (SSApp).


WPC Participant

Inmates who have been enrolled in WPC or who are in the process of being enrolled.


Department of Health Services (DHS)

An integrated system of providers, clinics and hospitals.  DHS provides healthcare to youth in the juvenile justice system, to inmates in County jails, and to a population of children in foster care.


DHS Medical Case Worker (MCW)

DHS staff assigned to assist WPC participants or prospective participants with the MC application process.


Los Angeles Sheriff’s Department (LASD)

The law enforcement agency responsible for securing, approximately 18,000 inmates in 7 custody facilities (jails) located within Los Angeles County. 


LASD Custody Assistant (CA) 

LASD staff responsible for assisting the WPC Participant (inmate) in completing/submitting a MC application via Your Benefits Now (YBN).  


Personally Identifiable Information (PII) 

Information that can be used to search for or identify individuals, or any information used to access an individual’s file, (such as, but not limited to; name, Social Security Number (SSN), date of birth, driver’s license number, or Client Index Number (CIN)).  


Automated Eligibility Verification System (AEVS) 

System used by Providers to verify:

  1. A beneficiary’s MC eligibility for current and/or prior 12 months;
  2. Share of Cost (SOC);
  3. Other Health Care Coverage and Prepaid Health Plan (PHP) status;
  4. Beneficiaries in fee-for-service pending enrollment into a MC managed care plan, a Denti-Cal managed care plan, or both;
  5. Service restrictions placed on the beneficiary,
  6. Clearing SOC liability; and
  7. How podiatrists and certain allied health providers may reserve Medi-Services.

Pre-Release Applications

The County must take necessary steps to complete a MC evaluation for an incarcerated individual prior to their release from detention, if the individual was not receiving MC at the time of incarceration.
