To convert existing policy to new writing style and revision of existing policy.
AB 402 allows Local Education Agencies (LEAs), who have entered into a Memorandum of Understanding (MOU) with the Department of Public Social Services (DPSS), and have parent/guardian’s consent to share with DPSS the approved National School Lunch Program (NSLP) applications for participation in the CalFresh Program. LEAs are required to have a signed “Parental or Guardian Consent to Release School Meal Application to the CalFresh Program,” or use the revised school lunch application that incorporates the consent section before sharing information.
The NSLP application serves as an initial request for a CalFresh application for the household of the NSLP student, who may be eligible to receive CalFresh benefits. The NSLP information is confidential. DPSS can neither share the NSLP information with other agencies, nor use it for any purpose other than enrollment in the CalFresh Program. In order to start the application process a CalFresh application is needed.
AB 402 was signed into law by Governor Jerry Brown on October 5, 2011. This bill allows LEAs to share with DPSS the approved NSLP applications.
LEAs are public, nonprofit private schools, and residential child care institutions.
