Policy

A Cash Assistance Program for Immigrants (CAPI) applicant/participant must apply for all other benefits for which they may be potentially eligible for to be eligible or remain eligible for CAPI benefits.  Other benefits include ongoing or one-time benefit payments such as Supplemental Security Income/State Supplementary Payment (SSI/SSP), Title II Social Security, Veterans’ benefits, annuities, pensions, retirement benefits, disability benefits, unemployment or workers compensation, Social Security benefits, or any other private pensions.

An applicant/participant who does not file for other benefits within 30 days of receiving the Eligibility Worker’s (EW) referral is not eligible or does not remain eligible for CAPI, unless the EW determines that a good reason exists for not filing within the 30-day period.  Filing for other benefits also includes cooperating with the other agencies by providing all requested information and evidence.

 

Other Programs

A CAPI applicant/participant may be eligible for additional benefit programs, such as Medi-Cal, CalFresh, or In-Home Supportive Services, while applying for or receiving CAPI benefits.  A CAPI applicant can potentially be eligible for General Relief while their CAPI application is pending. 

The EW should advise the CAPI applicant/participant of their potential eligibility for the other programs and make the appropriate referrals, especially when reviewing the applicant’s/participant’s responses on the SOC 814, Statement of Facts Cash Assistance Program for Immigrants (CAPI), and SOC 804, Statement of Facts for Determining Continuing Eligibility for Cash Assistance Program for Immigrants (CAPI).  The EW must ensure that the County Use only side for both forms are marked accordingly when referrals are made. 

The SAWS 1, Coversheet to the Application for Cash Aid, Food Stamps, and/or Medi-Cal/34-County Medical Services Program (CMSP), may be used as a protective filing for either Medi-Cal or CalFresh, allowing the applicant to receive benefits beginning the day that their application, whether partially or fully completed, was submitted.  However, the individual must still complete the application process for the other programs.


Background

Under the provisions of the 1998 Budget Act Implementation Bill for Social Services (Assembly Bill 2779, Chapter 329), some immigrants no longer eligible for SSI/SSP will now be eligible for CAPI.  For CAPI eligibility, AB 2779 requires individuals to successfully complete an application process, meet the immigration status criteria of SSI/SSP in effect on August 21, 1996, meet all other current SSI/SSP eligibility criteria, and be ineligible for SSI/SSP solely due to their immigration status under Title IV of P.L. 104-193.  CAPI applicants will have to meet eligibility requirements related to their age or disability, immigration status, income, resources, living arrangements, and pursuit of other potential benefits.

Terms and Descriptions


In-Home Supportive Services (IHSS)

The program helps pay for services provided to low-income elderly, blind or disabled individuals, including children, so that they can remain safely in their own home.  IHSS is considered an alternative to out-of-home care, such as nursing homes or board and care facilities.  IHSS is a benefit of Medi-Cal.  CAPI applicants/participants who apply for IHSS must also apply and be eligible to Medi-Cal.   

Some of the services that can be authorized through IHSS include house cleaning, meal preparation, laundry, grocery shopping, personal care services (such as bowel and bladder care, bathing, grooming and paramedical services), accompaniment to medical appointments, and protective supervision for the mentally impaired.

Qualified Alien

Any non-citizen who is:

  1. Lawfully admitted for Permanent Residence (LAPR).

  2. Granted Cuban/Haitian entrant status. (Section 501€ of the Refugee Education Assistance Act of 1980).

  3. A refugee who entered the United States under Section 207 of the Immigration and Nationality Acts (INA), The Immigration Reform and Control Act of 1986.

  4. Granted status as an asylee under Section 208 of the INA.

  5. A non-citizen whose deportation is being withheld under Section 243(h), or whose removal is being withheld under Section 241 (b)(3) of the INA.

  6. A non-citizen paroled into the United States for a period of at least one year under Section 212(d)(5) of the INA.

  7. A conditional entrant admitted to the United States under Section 203(a)(7) of the INA as in effect before April 1, 1980.

  8. A battered non-citizen, child of a battered spouse, or parent of a battered child with a petition pending under Section 204(a)(1)(A) or (B) or 244(a)(3) of the INA.

Supplemental Security Income (SSI)/State Supplemental Payment (SSP)

SSI/SSP refers to Federal (SSI) and State (SSP) funded program that provides cash assistance to aged, blind, and disabled residents of California.


Requirements

One of the CAPI eligibility requirements is ineligibility for SSI/SSP.  When an EW makes the referral for SSI/SSP, a qualified alien (refer to 49-020: Immigration Status) applicant/participant must:

  1. File for SSI/SSP benefits; (Attachment A) 

  2. Cooperate with the Social Security Administration (SSA) by providing all requested information and evidence; 

  3. Have an SSI/SSP denial letter due to immigration status dated within six months of the CAPI application date; and

  4. Appeal the disability decision if they have been denied SSI/SSP because of a determination that he or she is not disabled.

An applicant/participant is eligible or remains eligible for CAPI benefits while the SSI/SSP claim or appeal of an immigration status or disability issue is pending, if they fully cooperates in the application and administrative appeal process of the SSA.  An applicant/participant who does not file for SSI/SSP within 30 days of receiving the EW referral is not eligible or does not remain eligible for CAPI, unless the EW determines that a good reason exists for not filing within the 30-day period (refer to 49-030: Ineligibility for SSI/SSP).  A CAPI applicant/participant who has PRUCOL (refer to 49-020_1: PRUCOL) immigration status is not required to file for SSI/SSP benefits.

Applying for SSI/SSP

The CAPI EW is required to determine which advocacy activities would most likely help a CAPI applicant/participant become eligible for SSI/SSP, and to provide those activities.


 Responsible Staff and Activity


Eligibility Worker Must:

  1. Refer an applicant/participant who they believe to be eligible for SSI/SSP to file for SSI/SSP regardless of any previous determinations by the SSA.

  2. Refer the applicant/participant who they believe to be eligible for another benefit (Title II Social Security, Veterans’ benefits, annuities, pensions, retirement benefits, disability benefits, unemployment or workers compensation, Social Security benefits, or any other private pensions) to file for that benefit and provide proof of the filing.  

  3. Refer the applicant/participant to their corresponding SSA office (Attachment A) or one of the Community Organizations listed on the “Discontinuance of the CAPI SSI Advocacy Program” flyer (Attachment B).   

  4. Assist an applicant/participant in sending completed SSI packets to the corresponding SSA office, as necessary.  Questions can also be directed to the Countywide Benefits Entitlement Services Team (CBEST) staff in the district offices to further assist the applicant/participant. 

  5. Submit completed forms to SSI and disability packets to State Disability Determination Services Division (DDSD) (refer to 49-025:  Age and Disability).

  6. Act as a liaison with SSA and the DDSD to ensure that all SSI related requirements are met for SSI approval.

  7. Make themselves available to answer general questions related to the CAPI applicant’s/participant’s SSI/SSP disability claim.

 

If SSA Issues a Non-Medical Denial to an Applicant/Participant, Then...

The EW must make their own determination regarding SSA's decision (refer to 49-025: Age and Disability and 49-030: Ineligibility for SSI/SSP).

 

If SSA's Decision is Believed to Be Correct, Then...

The applicant/participant should not be referred to appeal the decision. 

 

If SSA's Decision is Believed to Be Incorrect, Then...

The EW must make a referral to appeal the decision (Attachment B). 

Encouraging Applicants to Apply for Medi-Cal Benefits

District office staff must offer all CAPI applicants the opportunity to apply for Medi-Cal benefits.  All applications for Medi-Cal should be processed following existing guidelines.

If an Applicant/Participant Decides to Apply for Medi-Cal, Then...

Medi-Cal should be checked on the SAWS 1 or EW must provide the Single Streamlined Application (SSApp) to the applicant and ask them to complete. (refer to Forms Instruction: SAWS 1). The applicant is not required to complete another SAWS 1.


If the CAPI Application is Denied or Withdrawn, Then...

The EW must ensure that the Medi-Cal application is processed by encouraging the applicant to complete the SSApp.


If the Applicant/Participant Completed the SSApp, Then...

The EW must either determine Medi-Cal eligibility or refer the case to a Medi-Cal Intake EW.

Note: In this case, the applicant must be informed (verbally or in writing) that their Medi-Cal application will be assigned to another EW who will process the application by telephone and/or mail.  The applicant is not required to come into the district office again.
