What changed?

  1. The General Relief (GR) policy has been revised to include the new definition of the parole/probation violators based on All County Letter (ACL) No. 15-82, Definition of Fleeing Felon and Parole/Probation Violators For the CalFresh Program; and
  2. To provide California Statewide Automated Welfare System (CalSAWS) instructions to Eligibility staff on how to update the information of the household member who is a parole/probation violator with a pending application or an approved case.

Policy

Any applicant/participant who is in violation of parole/probation is not eligible for GR. An applicant/participant is defined to be a parole/probation violator when both of the following applies:

  1. It is determined by a neutral party such as a judge or officially sanctioned tribunal that the individual is in violation of a condition of his/her parole/ probation imposed under federal or state law; and 
  2. A law enforcement agency (federal, state, or local) is actively seeking the individual to enforce the conditions of parole/probation.

GR benefits may be discontinued or denied when the Department of Public Social Services (DPSS) verifies that an applicant/participant is a parole/probation violator and is being actively sought by law enforcement. DPSS begins this process based on information obtained from:

  1. The applicant/participant through self-declaration; 
  2. California Department of Social Services (CDSS) Fleeing Felon Match (FFM) Monthly Abstracts; and 
  3. Assembly Bill (AB) 109-Probation Violators List.

The warrants that appear on the FFM monthly report are reviewed and processed by the Welfare Fraud Prevention & Investigations (WFP&I) Section. WFP&I will conduct an assessment to determine if the individual meets the parole/probation violators criteria, then will notify the district offices for final eligibility determination and appropriate case action. Warrant information provided by CDSS or Probation Department is validated manually and may become obsolete on a daily basis as applicants/participants resolve their active warrants.


Background

CDSS, through ACL 15-82, dated October 14, 2015, effective December 1, 2015, provides county welfare departments instructions for CalFresh eligibility for individuals who may have violated a condition of their parole/probation. DPSS will apply the same standard of eligibility for GR.


Definitions

Parole/Probation Violator

An applicant/participant is defined to be a parole/probation violator when both of the following applies:

  1. It is determined by a neutral party such as judge or officially sanctioned tribunal that the individual is in violation of a condition of their probation or parole imposed under federal or state law; and
  2. A law enforcement agency (federal, state, or local) is actively seeking the individual to enforce the conditions of probation or parole.

Warrant

A court order which directs a law enforcement officer to arrest and bring a person before the judge. The person is charged with a crime or convicted of a crime but failed to appear for sentencing, owes, or is in contempt of the court.


AB 109 Probation Violators List

A report received by GR Program Section from the Probation Department that lists the applicants/participants who have a felony warrant for violating probation.


Requirements

All applicants/participants must be compliant with the terms of their probation or parole in order to be eligible to receive GR benefits.


Verification Docs

If verification is received that the applicant/participant is in violation of parole/ probation, the applicant/participant becomes ineligible for GR until one of the following verification of the active warrant resolution is provided:


Court Verification

Any document from the Court Office Clerk that verifies the date of warrant resolution.


Letter from Probation Officer

A letter from the probation officer that verifies the date of warrant resolution.


Letter from Wanting Agency

A letter from the wanting agency that verifies the date of warrant resolution.
