Program Referral Process for Post-Release Supervised Persons (PSPs)
In compliance with Assembly Bill (AB) 109, Public Safety Realignment, the Department of Public Social Services (DPSS) is responsible for offering benefits for recently released parolees, referred to as PSPs, for the following programs:
Designated Medi-Cal Outreach District (MOD) staff co-located at the Probation Department HUBs are responsible for offering benefits to PSPs as follows:
For Medi-Cal:
A Pre-Release Medi-Cal Evaluation is conducted prior to a County or State inmate’s release from incarceration to ensure inmates have access to health coverage. If the inmate is eligible, a temporary Benefit Issuance Card is provided upon the inmate’s release. Details in relation to policy and business processes are outlined in the following Medical Section Policy: Medi-Cal Program Policy.
As a result of the Pre-Release Medi-Cal Evaluation process, most PSPs will be evaluated for Medi-Cal prior to their release from incarceration. However, if a PSP has a need for Medi-Cal benefits after their release, designated MOD staff co-located at the Probation Department HUBs can process and complete the Medi-Cal application as noted above.
AB 109 Probation Violators Listing
DPSS is responsible for removing individuals from aid when they are in violation of their probation or parole. The AB 109 Probation Violators Listing is received on a weekly basis where Eligibility staff are required to remove the violators listed from the following cases:
General Relief Program staff receive and prepare the listing and forward the cases to the district offices for processing weekly. The listing includes individuals who are not in compliance with the terms of their probation or parole.
The AB 109 Probation Violators Listing is not considered for CalFresh and Medi-Cal cases as individuals in violation of their probation or parole are processed differently for these programs. Please refer to the following ARs in AEM for more information:
Information on the AB 109 Probation Violators Listing contains Personally Identifiable Information (PII) that must be protected to maintain the confidentiality, integrity, and availability of such information as required by Welfare and Institutions Code Sections 10850-10853 and Federal Rules of Civil Procedure No. 26 and No. 34.
In April 2011, the California Legislature passed AB 109 (Chapter 15, Statutes of 2011), Public Safety Realignment to transfer responsibility for the supervision of non-violent, non-serious, non-sex offender inmates, and parolee populations, referred to as PSPs, from the California Department of Corrections and Rehabilitation (CDCR) to counties. AB 117 (Chapter 35, Statutes of 2011), Public Safety Realignment, was passed to delay the implementation of the transfer to October 2011. As such, effective October 1, 2011, CDCR began to release and place non-violent, non-serious, and non-sex offender prisoners under the supervision of the local Probation Department.
The Los Angeles County Board of Supervisors designated the Probation Department as the lead agency for the new PSP partnership. The partnership includes the following County Departments:

AB 109 Probation Violators Listing
A weekly report received from the Probation Department that lists the applicants/participants who are in violation of their probation or parole.
From June 2013 – April 2018, CalWORKs Program was responsible for receiving and forwarding the listing to the designated district offices for processing. Effective May 2018, General Relief Program is responsible for receiving and forwarding the listing to the designated district offices for processing.
Parole/Probation Violator (PPV)
A PPV is defined as a person in violation of a condition of their probation or parole. The initial offense for which the probation or parole was ordered need not have been a felony.
An applicant/participant is labeled a PPV when the following occurs:
Compliance with Probation/Parole Terms
All applicants and participants must be compliant with the terms of their probation or parole in order to be eligible to receive CalWORKs, CalFresh, and General Relief benefits.
For CalWORKs and General Relief
Applicants/Participants may be denied or discontinued if they are in violation of their probation or parole and the County is informed by:
If the participant is deemed a PPV, the individual must be removed from the case at the end of the month the information becomes known to the County with a ten-day Notice of Action (NOA) as this is considered a County-Initiated Action.
For CalFresh
CalFresh applicants/participants may be denied discontinued if they are in violation of their probation or parole upon receipt of the CF FFPPV, Fleeing Felon and Parole or Probation Violator Verification Request for CalFresh Two-Way Gram, or the WFP&I 369, Fleeing Felon Case Identification Information form by Welfare Fraud Prevention & Investigation (WFP&I). Refer to AR 63-402.22 Fleeing Felons and Probation or Parole Violators for more information.
PPVs Periodic Reporting Responsibilities
CalWORKs and General Relief applicants/participants who are deemed PPVs must report they are in violation of their probation or parole as follows:
When information is received from the Probation Department that the applicant/participant is in violation of their probation or parole, the PPV must be removed at the end of the month the information becomes known to the county with a ten-day NOA. The removal of the PPV from the Assistance Unit (AU)/Household (HH) is considered a County-Initiated Action.
For CalFresh
CalFresh applicants/participants may self-declare their PPV status. Refer to AR 63-402.22 Fleeing Felons and Probation or Parole Violators for more information.
Probation Department HUBs
Upon release, the PSP must report to one of the three Probation Department HUBs noted below for orientation, assessment and assignment for supervision. During orientation, the PSP will be referred to the on-site DPSS Eligibility Worker (EW) from MOD who will process and complete the CalFresh and/or Medi-Cal application.
The EW does not complete applications for other program benefits, such as CalWORKs and General Relief, but will evaluate for potential eligibility and make a referral to the appropriate DPSS district office for services.

Note: There is no co-located staff at the Probation Department HUB in Los Angeles which is why it is not noted within this section.
Confidentiality
Should a PSP request to be added to an existing case, staff must not divulge any information on existing cases to the PSP.
Staff shall inform the PSP that they may apply for benefits on their own behalf, unless a request from the parent/caretaker relative or Authorized Representative is received to add the PSP to an existing case.
For CalFresh, staff must consider household composition and purchase/prepare rules prior to informing the PSP that they may apply for benefits on their own to determine if recommendation is applicable.
If verification is received that the applicant/participant is a PPV, the applicant/participant becomes ineligible to receive CalWORKs, CalFresh or General Relief benefits until one of the following verifications is provided that the applicant/participant is no longer a PPV. The following verification is acceptable:

Court Verification; Any document from the Court Office Clerk verifying the date of warrant resolution.
Letter from Probation Officer; A letter from the probation officer verifying the date of warrant resolution.
Letter from Wanting Agency; A letter from the wanting agency verifying the date the warrant resolution.
